The VoxNotes App and the VoxNotes Service are distinct and independent entities:

The VoxNotes App is the
client software on your phone. It can send voice messages and contacts via
email directly to the recipient, and receive VoxNotes
sent to you from anywhere. It can also access the VoxNotes
Service

VoxNotes Service is
a voice communications service on the Internet that can relay your messages to
other app users as an instant voice message and to any phone in the world as an
automated message delivery phone call. When you download the VoxNotes App you get a limited amount of free use of the VoxNotes Service. Beyond that, you will need to purchase
service credits to access & use the features of the VoxNotes
Service
App Users
VoxNotes, QuickVox and Contact Send (“Products”) are licensed under the APPLE iPHONE LICENSED APPLICATION END USER LICENSE AGREEMENT located at http://www.apple.com/legal/itunes/appstore/dev/stdeula/ .
App and Service Users
In addition to
the above, please note the following:

AppManiax provides the communication services included in VoxNotes Service through the use of servers that relay the
messages to the intended recipient.

AppManiax makes no guarantees as to the uptime or continued
availability of these servers.
·
AppManiax is not responsible for these messages not being
delivered in a timely way or at all or incorrectly or incompletely, or to the
wrong recipient.
·
The purchase
price paid for the application ($0 if free) on the App Store grants you the
license to use the application on your device to send VoxNotes
and contacts via email as well as receive VoxNotes. Also,
when you download the app, you get a limited amount of free use of the VoxNotes Service and its features. This free starter credit
may be withdrawn at any time.
·
To continue accessing
and using the VoxNotes Service after your free
starter credit has run out, you need to purchase VoxNotes
Service credit.

Fair
Usage Limits

The
communications through these products is subject at all times to certain fair
usage limits which are subject to change. These limits apply to:
o
The size
and duration of a single message
o
The
number of messages in any given period
o
Total
bandwidth consumed within a given period

Please understand
that it costs from hundreds to thousands of dollars per month to operate the
servers necessary to provide the message processing services. Our pricing is
ridiculously low considering our costs. We are taking a significant financial
risk in order to launch the service and gain user acceptance. Depending on the
volume of usage, we will have to review our ongoing pricing in order to be able
to continue to provide good quality service.
